EU court finds Qualcomm guilty of predatory pricing | Infinium-tech
The EU’s second-highest court confirmed the earlier ruling and found Qualcomm guilty of what is known as predatory pricing. However, the court reduced the fine from €242 million to €238.7 million.
The case relates to Qualcomm’s contract with British software maker Icera, now part of Nvidia. Between 2009 and 2011 Qualcomm sold chips at prices below cost. This practice is intended to exclude other competitors from potential deals.
Qualcomm has filed multiple appeals, including one claiming that the Qualcomm-Isera deal represents just 0.7% of the universal mobile telecommunications systems market, making the case insignificant. However, the European Court of Justice only accepted the appeal that sought a reduction in the fine, so little adjustment was made.
It doesn’t end there, however, as Qualcomm can now appeal to the EU Court of Justice, the highest level of the union’s system.
